. so, that didn't happen in our case. and then lastly, i'm not too familiar with the actual language that says when lien notices can be sent out, but i'd like to point out something that may be a possibility, which is even though the law may saline notices can't be sent out until the second bill is past due, what about sending out notices. it doesn't have to be a notice, a lien notice. it could be just a postcard oring? something like that. so, lastly, to clear this up, in the proposal they say that they would send out something 45 days after the bill was due. that's still 75 days of water usage. 75 days of water usage has occurred then under that case under the new recommendation. and that's 2-1/2 months of water usage we'll have no control about. if they do collect two months' worth of security [speaker not understood]. technically they send it out -- the date they send it out is not the date we receive t. we receive it some days later so thank you for the opportunity to speak in front of you. >> so, who with have you spoken to on our staff? >>> to todd and marge. and they're here.

lastly, we of the bar association and their resources. they're providing their legal service for you. this last thing i am going to share with you in terms of what we have seen in our office is that with the individuals, that does not necessarily mean an individual will follow up with a lawsuit. what we've seen in our office is the individual's will send you a letter and say there were compile -- compliance issues. where people get in trouble is they ignore the letter. we need to make sure it that your pro-active and responsive. when a business receives a letter, they need to contact our office. the merchants of been very proactive -- have been very pro- active. the businesses that have received a letter and passed an inspection after receiving the letter have staved off a lawsuit. the cap inspection is a very good risk management tool. often it is not as durable as you may think it to be. our office is there for you as our resources. we are able to provide our services, follow-up questions in english, spanish, cantonese, and mandarin. and then -- and then, roger, you will -- >> yes.

it. lastly, the partners recently announced a stop bullying video challenge where we are bringing together psa's that highlight what's happening by young people and want to give awards and celebrate that. and, as i mentioned earlier, the grants, the money, the department of education has issued 11 grants to schools. we need more, we will see as budget proposals the president's and the secretary's real commitment to this to ensure that we have some resources for innovative programs that are happening across the country for those local programs that are really changing the way their schools function and their communities see their schools and promoting those and scaling them up. >> very quickly because i know we want to move on, the attorney general launched a defending childhood initiative, i know there's a lot of philanthropy in the room, we want to work in partnership to find those innovative programs. there was a jurisdiction in north dakota that got a grant to implement some of the restoretive justice programs, the superintendent mentioned those. those have shown real potential

enforcement to drive the -- [inaudible] >> yes. >> and lastly, will the federal establishment be as sensitive to the economic issues? >> that's an important set of questions. i don't talk about the federal system as much because they're on the opposite trajectory. so the federal system, as was just mentioned, is actually expanding. the bureau of prisons budget actually expanded this past year. it is going kind of counter to the direction that states are going in, and the aclu sponsored a couple of hearings in congress where states leaders, from states that i do have enacted significant reform, presented the story of what had happened in their state and trying to kind of motivate reform in the federal system. the reality is that the economic pressures facing the states instead of governments don't exist in the same way as they do with the federal government. so the federal government isn't feeling that same bench. state governments have to balance their budgets. the federal government doesn't, and so there are few pressures on the federal government to actually have to deal with this

efficiencies and achieve results. lastly, congress should not impose maintenance of effort provisions of states as a condition of receiving federal funding. in other words, it states receive federal cuts, washington should not demand the same level of service without providing the same level of funding. essentially, all of these points can and will be coming down to flexibility and partnership. we need the flexibility to take care of the unique needs of our citizens and the challenges of our states. what we do not need is a one- size-fits-all solution or more unfunded federal mandates passed on to our states. the need to be treated as partners, not underlings. we want to work to implement good public policy. as we told congressional leaders, reducing the deficit by shifting costs to the state is not indicative of the good partnership. whether it is deficit reduction or other pressing national issues, we feel the two principles will guide these relationships with the federal government and the state. the principles are the flexibility and the partnership. i will give you a couple of examp
